1. Parental Contracting & Account Responsibility
All accounts, subscriptions, and memberships in BrAIny Lab are entered into exclusively with Daniel Blake d/b/a Blake Learning Labs (North Carolina Sole Proprietorship) by a parent or legal guardian aged 18 or older. Children under 13 may access the creative suite solely under the direct supervision, authorization, and verifiable consent of their parent or legal guardian.
2. Family Intellectual Property & User Creations
To the fullest extent permitted by applicable copyright law, Daniel Blake d/b/a Blake Learning Labs assigns to the purchasing parent all right, title, and interest in and to the creative output generated by the child (stories, audio clips, and coloring sheets). We claim zero commercial ownership over family creations and do not sell, scrape, or license child work to third parties.
3. AI Service Availability & Content Disclaimer
BrAIny Lab utilizes automated artificial intelligence models and moderation filters (including OpenAI omni-moderation-latest and fal.ai). While multi-layered fail-closed safety filters operate on every request, generative models may occasionally produce unexpected text or drawings. The service is provided on an "as-is" and "as-available" basis for educational and creative enrichment.
4. Governing Law, North Carolina Venue & Limitation of Liability
These terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any principles of conflicts of law. Any legal proceeding arising out of or relating to this agreement shall be brought in the state or federal courts located in Pitt County, North Carolina.
